MEDIATION
Mediation is defined as ‘a settlement of a dispute or controversy by setting up an independent person between two contending parties to aid them in the settlement of their disagreement.’
The role of the mediator is to find points of agreement and make those in conflict agree on a fair result. Mediation differs from arbitration where there is an outcome (one party is a winner and one is a loser). Mediation is a formal process and the mediator does not actively participate in the discussion other than to assist the parties to find a mutually agreeable settlement.
Mediation has become very common in divorce, child custody and visitation matters. It is also very effective in settling contract and civil damage cases. Although very effective, mediation does not always result in a settlement but can help the parties move closer to a settlement.
